1. Acceptance of terms
These Terms and Conditions (“Terms”) govern your access to and use of the Gelom Technologies website at gtechltd.com and, to the extent applicable, our managed cybersecurity and data protection services. By using this website or engaging Gelom Technologies as a client, you agree to these Terms. Where a signed service agreement or statement of work exists between Gelom Technologies and a client, that agreement takes precedence over these Terms in the event of a conflict.
2. Definitions
- “Gelom”, “we”, “us”, “our” refers to Gelom Technologies, a Nairobi-based managed cybersecurity and compliance company.
- “Client”, “you”, “your” refers to any organisation or individual using this website or engaging our services.
- “Services” refers to the managed cybersecurity, monitoring, incident response, compliance and related services offered by Gelom Technologies.
3. Use of this website
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of, this website by anyone else. You must not attempt to gain unauthorised access to this website, the server on which it is hosted, or any server, computer or database connected to it.
4. Our services
Gelom Technologies provides managed cybersecurity and data protection services, delivered as an outsourced function across four areas: protect, monitor, comply, and respond. The specific scope, deliverables, service levels and duration of services provided to a client are set out in a separate service agreement, proposal or statement of work, which forms a binding contract once accepted by both parties. General descriptions of services on this website are for information purposes and do not, on their own, constitute a binding offer.
5. Assessments and proposals
Free cyber risk and compliance assessments booked through this website are provided to help prospective clients understand their security and compliance posture. They do not constitute a comprehensive audit, legal advice, or a guarantee against future security incidents. Any recommendations arising from an assessment are advisory, and implementation remains the client’s decision unless a separate service agreement is in place.
6. Client obligations
Where you engage Gelom Technologies for services, you agree to:
- Provide accurate, complete and timely information about your organisation, systems and requirements.
- Grant necessary access, permissions and cooperation required for us to deliver the agreed services.
- Notify us promptly of any changes to your environment that may affect service delivery.
- Use our services only for lawful business purposes.
7. Intellectual property
All content on this website, including text, graphics, logos and design, is the property of Gelom Technologies or its licensors and is protected by applicable intellectual property laws. You may view and print content for personal, non-commercial use, but may not reproduce, distribute or modify it without our prior written consent. Any reports, dashboards or documentation produced for a client as part of a service engagement remain subject to the intellectual property terms set out in the relevant service agreement.
8. Confidentiality
In the course of delivering services, Gelom Technologies may have access to confidential and sensitive client information, including security findings and operational data. We treat this information as strictly confidential, use it only to deliver the agreed services, and do not disclose it to third parties except as required by law, with client consent, or as necessary to deliver the service (for example, to a trusted technology partner under confidentiality obligations). Detailed confidentiality terms are set out in the applicable service agreement.
9. Fees and subscriptions
Fees for our services, including any subscription-based packages, are set out in the applicable proposal or service agreement. Unless otherwise agreed in writing, fees are payable in accordance with the payment terms specified in that agreement. We reserve the right to adjust pricing for future subscription periods with reasonable notice.
10. Limitation of liability
While we take reasonable and professional care in delivering our services, no cybersecurity service can guarantee absolute prevention of every threat, breach or compliance gap. To the maximum extent permitted by law, Gelom Technologies shall not be liable for any indirect, incidental or consequential loss arising from use of this website or our services, except where such liability cannot be excluded by law, or as otherwise agreed in a signed service agreement. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Kenyan law.
11. Indemnification
You agree to indemnify and hold Gelom Technologies harmless from any claims, losses or damages arising from your misuse of this website, breach of these Terms, or provision of inaccurate information that affects our ability to deliver services correctly.
12. Termination
We may suspend or restrict access to this website at our discretion, including in cases of suspected misuse. Termination of a client service agreement is governed by the terms set out in that agreement, including any applicable notice periods.
13. Governing law and disputes
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or use of this website shall first be addressed through good-faith negotiation between the parties, and if unresolved, shall be subject to the exclusive jurisdiction of the courts of Kenya, unless a separate service agreement specifies an alternative dispute resolution process.
14. Changes to these terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The date at the top of this page shows when it was last revised. Continued use of this website after changes are posted constitutes acceptance of the updated Terms.
